1. Services Provided

IP Vantage specializes in professional patent illustration services, including but not limited to:

• Utility Patent Drawings (Mechanical, Electrical, Software, Biotech, etc.)
• Design Patent Drawings (Isometric views, surface shading, exploded views)
• Flowcharts & Diagrams (Method, process, and software claims)
• Office Action / Rejected Drawings (Corrections for examiner objections)

All drawings are prepared based on the source materials, sketches, files, or descriptions provided by the Client, aiming for compliance with global filing standards such as the USPTO (37 CFR 1.84), EPO, and PCT/WIPO.

2. Client Inputs & Source Materials

To initiate a project, you must provide clear source materials, which may include hand-drawn sketches, CAD files (STEP, STL, OBJ, FBX), 3D renderings, photographs, or detailed text descriptions.

• Accuracy: You are solely responsible for the accuracy, completeness, and clarity of the data and instructions you provide. IP Vantage is not liable for errors in final drawings resulting from vague, inaccurate, or misleading source data.
• Rights to Content: By submitting materials to us, you warrant that you own or have the legal right to possess and share those materials and that our use of them will not infringe upon any third party’s intellectual property rights.

3. Confidentiality & Non-Disclosure Agreements (NDA)

We understand the highly sensitive, proprietary nature of patent applications and inventions.

• We enforce strict internal confidentiality protocols for all client projects.
• We are fully willing to sign a formal Non-Disclosure Agreement (NDA) prior to receiving any sensitive project data.
• Even in the absence of a signed separate NDA, we treat all submitted designs, concepts, and communications as strictly confidential and will not disclose them to any third parties without your explicit consent.

4. Turnaround Times & Delivery

• Standard Turnaround: Our standard delivery window is typically 36 to 72 hours, depending on project volume and complexity.
• Rush Orders: Expedited rush delivery options are available upon request for urgent filing deadlines and must be explicitly agreed upon in writing at the time of order confirmation.
• Delays: While we make every effort to meet project deadlines, delivery timelines are estimates. IP Vantage is not liable for any losses, missed filing deadlines, or damages resulting from unforeseen technical delays, communication gaps, or incomplete initial inputs from the client.

5. Revisions & Compliance Guarantee

• Unlimited Revisions: We provide unlimited revisions to our drawings until you are fully satisfied, provided that the requested revisions align with the project's original scope and source materials.
• Compliance: We guarantee that our drawings are formatted to meet the specific patent office guidelines requested (e.g., USPTO, PCT). If a patent office objects to a drawing drafted by us due to a formatting error on our part, we will correct the drawing at no additional cost.
• Scope Changes: Revisions that introduce entirely new concepts, features, or substantial modifications not included in the original project submission will be treated as a new project scope and may incur additional charges.

6. Fees, Quotes, & Payments

• Quotes: Pricing is determined transparently on a per-project or per-sheet basis, depending on structural complexity. We provide written quotes before work begins.
• Invoicing: Invoices are issued upon project delivery or milestones as agreed.
• Payment Terms: Payment must be made in full according to the terms specified on the invoice. We reserve the right to withhold final high-resolution deliverables or suspend ongoing revisions if payments are overdue.

7. Intellectual Property Ownership

• Your Inventions: IP Vantage claims absolutely no ownership over the concepts, designs, or inventions illustrated in the drawings.
• The Drawings: Upon full payment of all outstanding invoices for a project, the complete legal ownership, copyrights, and intellectual property rights of the finalized custom drawings transfer entirely to the Client.
• Website Content: All text, branding, graphics, and code layout present on https://ipvantage.com/ are the intellectual property of IP Vantage and may not be copied or reproduced without permission.

8. Limitation of Liability

To the maximum extent permitted by applicable law, IP Vantage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or the rejection/denial of any patent application by a patent office. Our maximum cumulative liability for any claim arising out of or relating to our services shall not exceed the total amount paid by you to IP Vantage for the specific project in question.

9. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of India, with exclusive jurisdiction granted to the courts located in New Delhi, Delhi.

10. Modifications to Terms

IP Vantage reserves the right to update or modify these Terms of Service at any time without prior notice. Any changes will become effective immediately upon being posted to this page. Your continued use of our website or services following any updates constitutes acceptance of the revised Terms.
